Terms and conditions

Welcome to the Real Estate AI Institute Affiliate Program. These Terms and Conditions ("Terms") govern your participation in our Affiliate Program. By registering as an affiliate, you agree to be bound by these Terms. Please read them carefully before submitting your application.

 

Throughout these Terms, "we," "us," and "our" refer to Real Estate AI LLC, doing business as Real Estate AI Institute. "You" and "your" refer to you, the affiliate.

 

1. Program Overview

The Real Estate AI Institute Affiliate Program allows approved participants to earn commissions by referring new customers to our training workshops, programs, and related offerings. You will receive a unique tracking link and a personalized coupon code to share with your audience. When someone makes a qualifying purchase through your link or using your code, you earn a commission.

 

2. Eligibility and Enrollment

To participate in the Affiliate Program, you must:

 

Be at least 18 years of age.

Submit a complete affiliate application through our website.

Provide accurate and truthful information during registration, including your legal name, email address, phone number, and mailing address.

Receive written approval from Real Estate AI Institute. Submitting an application does not guarantee acceptance.

 

We reserve the right to accept or reject any application at our sole discretion, and we are not required to provide a reason for rejection. We may also request additional information before approving your application.

 

3. Commission Structure

3a. Commission Rates

Approved affiliates earn a percentage-based commission on each qualifying sale referred through their unique tracking link or coupon code. The default commission rate is 10% of the purchase price. Commission rates may vary by product, promotion, or individual affiliate agreement, and we reserve the right to modify rates at any time with reasonable notice.

 

3b. Qualifying Sales

For a sale to be eligible for a commission, all of the following conditions must be met:

 

The customer must click your unique affiliate tracking link or use your assigned coupon code before completing their purchase.

The purchase must occur within 90 days of the customer's initial click on your affiliate link (the "cookie window").

The customer must be a new customer making a first-time purchase of the referred product, unless otherwise specified.

The transaction must not be refunded, charged back, or otherwise reversed.

The sale must not result from a self-referral (see Section 6 for details).

 

3c. Attribution

We use a "last click wins" attribution model. This means that if a customer clicks on multiple affiliate links before making a purchase, the commission is awarded to the affiliate whose link was clicked most recently before the sale. We determine commission eligibility in our sole discretion and our tracking system is the authoritative record for all referral activity.

 

4. Coupon Codes

In addition to your unique tracking link, you may be assigned a personalized coupon code. Coupon codes may offer a discount to the customer (the discount amount is set by Real Estate AI Institute and may change over time), or they may carry a $0 discount and serve purely as a tracking mechanism.

 

You may not create, distribute, or promote any unauthorized coupon codes, discount offers, or promotional pricing for Real Estate AI Institute products. Only coupon codes officially assigned to you through the Affiliate Program may be used.

 

5. Payment Terms

5a. Payment Schedule

Commissions are paid on a monthly basis, on a Net-30 cycle. This means commissions earned in a given month are processed and paid approximately 30 days after the close of that month. For example, commissions earned in March would be paid at the end of April. This 30-day hold period allows time for refund processing and transaction verification.

 

5b. Minimum Payout Threshold

You must accumulate at least $100 in earned commissions before a payout is processed. If your balance does not meet this threshold at the end of a payment cycle, your earnings will roll over to the next month. Commissions are never forfeited due to being below the threshold; they will continue to accumulate.

 

5c. Payment Methods

Payments are made via digital payment methods, which may include PayPal, Zelle, or Venmo. You are responsible for providing accurate payment information and keeping it up to date. Any transaction fees charged by your payment provider are your responsibility.

 

5d. Adjustments and Clawbacks

If a customer receives a refund, initiates a chargeback, or if a transaction is otherwise reversed after a commission has been earned or paid, we reserve the right to deduct the corresponding commission from your current balance or from future commission payments.

 

6. Prohibited Activities

As an affiliate, you agree that you will NOT engage in any of the following activities. Violation of any of these terms may result in immediate suspension or termination of your affiliate account, forfeiture of unpaid commissions, and potential legal action.

 

6a. Paid Search and Brand Bidding

Bid on, purchase, or otherwise use our brand name, trademarks, product names, or any variations or misspellings thereof (including "Real Estate AI Institute," "Real Estate AI," "REAI," or any similar terms) as keywords in any pay-per-click (PPC) advertising platform, including but not limited to Google Ads, Bing Ads, Facebook Ads, and similar services.

Create paid advertisements that could be confused with our official advertising or that use our brand name in ad copy, display URLs, or landing pages without prior written approval.

 

6b. Spam and Unsolicited Communications

Send unsolicited bulk email (spam) promoting our products or your affiliate link.

Send unsolicited text messages, direct messages, or other electronic communications promoting our products.

Post your affiliate link or coupon code in comment sections, forums, or social media groups in a way that violates the platform's terms of service or community guidelines.

Use any form of automated messaging, bots, or scripts to distribute your affiliate link.

 

6c. Misleading or Deceptive Practices

Make false, exaggerated, or misleading claims about our products, services, pricing, or results.

Guarantee specific income, business results, or outcomes from using our training programs. You may share documented results and testimonials, but you must not present them as guaranteed or typical results.

Create content that falsely implies an official partnership, employment relationship, joint venture, or endorsement by Real Estate AI Institute beyond your role as an affiliate.

Use fake reviews, fabricated testimonials, or misleading comparison content.

 

6d. Fraud and Technical Manipulation

Engage in cookie stuffing, click fraud, bot traffic, or any other technique designed to artificially inflate clicks, impressions, or conversions.

Attempt to intercept, redirect, or hijack traffic intended for our website or for other affiliates.

Manipulate tracking systems, referral data, or commission reporting in any way.

Refer yourself, your own business, your immediate family members, or any entity you own or control in order to earn commissions (self-referrals). Self-referral commissions will be reversed and may result in account termination.

 

6e. Inappropriate Content and Placement

Promote our products on websites or platforms that contain pornography, graphic violence, hate speech, illegal content, or content that promotes discrimination of any kind.

Promote our products on websites or platforms that primarily feature gambling, drugs, alcohol, or weapons.

Promote our products using adware, spyware, malware, or any software that installs on a user's device without their explicit consent.

 

6f. Sub-Affiliate Networks

Create, operate, or participate in any sub-affiliate network or recruit other affiliates under your account without prior written approval from Real Estate AI Institute.

 

7. Brand Usage and Intellectual Property

7a. Approved Materials

We may provide you with approved marketing materials, including logos, images, descriptions, and other brand assets for use in promoting our programs. You may only use materials that have been officially provided or approved in writing by Real Estate AI Institute.

 

7b. Restrictions

You agree to the following restrictions regarding our brand and intellectual property:

 

Do not modify, alter, or create derivative works from our logos, trademarks, or brand assets.

Do not use our brand name, logos, or trademarks in your domain name, social media handle, email address, or business name.

Do not create any materials (websites, landing pages, social media profiles, etc.) that could reasonably be mistaken for official Real Estate AI Institute content.

Do not use our brand assets in any context that could damage, disparage, or dilute our brand reputation.

If you create your own promotional content (blog posts, social media content, videos, etc.), you must clearly identify it as your own content and include proper affiliate disclosure (see Section 8).

 

If you wish to create custom marketing materials featuring our brand, you must submit them to us for review and receive written approval before publishing or distributing them.

 

8. FTC Disclosure Requirements

Under the Federal Trade Commission (FTC) Endorsement Guides, you are legally required to clearly disclose your affiliate relationship with Real Estate AI Institute in all promotional content. This is not optional.

 

8a. Disclosure Standards

Your disclosure must meet all of the following criteria:

 

Clear and conspicuous: The disclosure must be easy to see, read, and understand. It cannot be hidden in fine print, buried at the bottom of a page, or obscured behind a "read more" link.

Prominent: The disclosure must appear near your affiliate link or promotional content, not in a separate location. On social media, include it within the post itself, not only in your profile bio.

Plain language: Use straightforward language that an average person can understand without effort.

Present in every piece of content: Every blog post, social media post, email, video, or other communication that includes your affiliate link or promotes our products must contain a disclosure.

 

8b. Acceptable Disclosure Examples

The following are examples of acceptable disclosures. You may use these or similar wording:

 

"Affiliate Disclosure: I may earn a commission if you purchase through my link, at no additional cost to you."

"This post contains affiliate links. If you make a purchase, I may receive a small commission."

"I am an affiliate of Real Estate AI Institute and may earn a referral fee for purchases made through my link."

On social media, using #ad or #affiliate in a clearly visible position within the post (not buried among other hashtags).

 

Failure to include proper FTC disclosures is a violation of these Terms and may result in suspension or termination of your affiliate account. Real Estate AI Institute may also be held liable for your failure to disclose, so we take this requirement seriously.

 

9. Tax Obligations

You are solely responsible for reporting your affiliate earnings and paying any applicable taxes. As an affiliate, you are an independent contractor, not an employee, partner, or agent of Real Estate AI Institute.

 

If you are a U.S.-based affiliate and earn $600 or more in commissions in a calendar year, we are required by law to file a Form 1099-NEC with the IRS reporting your earnings. Before your first payout, you will be required to submit a completed IRS Form W-9 with your legal name, address, and Taxpayer Identification Number (SSN or EIN). We cannot process any commission payments until a valid W-9 is on file.

 

If you fail to provide a W-9 within 60 days of your first qualifying commission, we reserve the right to withhold your payout until the form is received.

 

10. Confidentiality

During your participation in the Affiliate Program, you may receive non-public information about our business, including but not limited to commission structures, product plans, pricing strategies, customer data, and business metrics. You agree to keep all such information confidential and to not disclose it to any third party without our prior written consent. This obligation survives the termination of your participation in the Affiliate Program.

 

11. Termination

11a. Termination by Either Party

Either party may terminate your participation in the Affiliate Program at any time, for any reason or no reason, by providing written notice via email. No advance notice period is required, though we will make reasonable efforts to communicate any changes that affect your account.

 

11b. Termination for Cause

We may immediately suspend or terminate your affiliate account, without prior notice, if you:

 

Violate any of these Terms and Conditions.

Engage in any of the prohibited activities listed in Section 6.

Engage in fraudulent, illegal, or deceptive conduct.

Cause harm to the Real Estate AI Institute brand, reputation, or business.

Provide false or misleading information during registration or at any time during your participation.

 

11c. Effect of Termination

Voluntary termination or no-cause termination: If you voluntarily withdraw from the program, or if we terminate your account for reasons other than a policy violation, any earned commissions that meet the $100 minimum payout threshold will be paid on the next regular payment cycle. Commissions below the $100 threshold at the time of termination will be forfeited.

 

Termination for cause: If your account is terminated due to a violation of these Terms, fraudulent activity, or any prohibited conduct, all unpaid commissions are forfeited, regardless of the amount. We also reserve the right to reclaim previously paid commissions that were earned through fraudulent or prohibited means.

 

Upon termination for any reason, you must immediately:

 

Stop using your affiliate link and coupon code.

Stop representing yourself as an affiliate of Real Estate AI Institute.

Remove all Real Estate AI Institute marketing materials, logos, trademarks, and brand assets from your website, social media, and any other platforms within five (5) business days.

 

12. Limitation of Liability

Real Estate AI Institute provides the Affiliate Program on an "as is" basis, without warranties of any kind, whether express or implied. We do not guarantee the availability, accuracy, or reliability of our tracking and reporting systems, and we are not responsible for tracking failures caused by browser settings, cookie blockers, VPNs, or other technologies that may prevent proper attribution.

 

In no event shall Real Estate AI Institute be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your participation in the Affiliate Program, including but not limited to lost profits, lost business opportunities, or reputational harm.

 

Our total liability to you under these Terms shall not exceed the total commissions actually paid to you during the six (6) months immediately preceding the event giving rise to the claim.

 

13. Indemnification

You agree to indemnify, defend, and hold harmless Real Estate AI Institute, its owners, officers, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your participation in the Affiliate Program, your promotional activities, your violation of these Terms, or your violation of any applicable law or regulation.

 

14. Relationship of the Parties

You and Real Estate AI Institute are independent parties. Nothing in these Terms creates a partnership, joint venture, employment relationship, franchise, or agency relationship between you and Real Estate AI Institute. You have no authority to make any commitments, representations, or warranties on our behalf, and you must not suggest or imply that any such relationship exists.

 

15. Modifications to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through the affiliate portal. Your continued participation in the Affiliate Program after being notified of changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, your sole remedy is to terminate your participation in the program.

 

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any disputes arising out of or related to these Terms or your participation in the Affiliate Program shall be resolved through good-faith negotiation between the parties. If a resolution cannot be reached through negotiation, the dispute shall be submitted to binding arbitration in the State of Wyoming, conducted in accordance with the rules of the American Arbitration Association.

 

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and all remaining provisions will continue in full force and effect.

 

18. Entire Agreement

These Terms, together with any program policies or guidelines we provide through the affiliate portal, constitute the entire agreement between you and Real Estate AI Institute regarding the Affiliate Program and supersede all prior agreements, representations, and understandings related to the subject matter herein.
